1. Agreement to Terms

By accessing or using TunerMind ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

TunerMind is a software platform that analyzes HP Tuners CSV datalog files using artificial intelligence and returns diagnostic reports. The Service is intended for informational and educational purposes only. Reports generated by TunerMind are not a substitute for professional tuning advice, mechanical inspection, or certified diagnostic services.

3. Accounts and Access

You must authenticate via Manus OAuth to use the Service. You are responsible for all activity under your account. You may not share, sell, or transfer your account credentials to any third party.

4. Acceptable Use

You agree not to:

• Use the Service to train, fine-tune, or develop competing AI models or products
• Reverse engineer, decompile, or attempt to extract the underlying AI prompts, algorithms, or source code
• Use automated scripts, bots, or scrapers to access the Service or generate reports in bulk
• Resell, sublicense, or redistribute access to the Service or its outputs without written permission
• Upload files containing malicious code, personally identifiable information of others, or content that violates applicable law
• Circumvent rate limits, subscription tiers, or access controls

5. Intellectual Property

All software, AI models, prompts, analysis logic, design, and content comprising TunerMind are the exclusive intellectual property of TunerMind and its owners. These Terms do not grant you any ownership rights. You retain ownership of the datalog files you upload; by uploading them, you grant TunerMind a limited license to process them solely for the purpose of generating your report.

6. Subscription and Payments

Paid subscriptions are billed through Stripe. Subscriptions renew automatically unless cancelled. Refunds are handled on a case-by-case basis at our discretion. Free tier usage is limited to 3 analyses per account lifetime. We reserve the right to modify pricing with reasonable notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TunerMind MAKES NO REPRESENTATIONS THAT REPORTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. USE OF THE SERVICE IS AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY VEHICLE DAMAGE, MECHANICAL FAILURE, OR FINANCIAL LOSS ARISING FROM RELIANCE ON TunerMind REPORTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TunerMind AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the Service, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts of the United States.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.
